Vociamo terms of use
Version of 16 October 2026 (first version: 10 September 2026; on 1 October: colleagues are added from the Members page, not invited by email; on 16 October: the email address, now privacy@vociamo.app, and the audience's transcript download, turned on only by the customer). Not reviewed by a lawyer (owner's decision of 10 September: used as is for now, to be reviewed when one is available). In case of doubt the Italian version (CONDIZIONI.md) prevails.
1. Who we are and who these terms are for
The Vociamo service is provided by Alessandro Nardoni, via XXV Aprile 33, 50065 Pontassieve (FI), Italy, email privacy@vociamo.app ("we"). Heading chosen on 10 September 2026 for the trial tours; before the first paid tour the provider will become a sole trader or a company and this line will change.
These terms apply to the customer: the organisation (agency, museum, association, self-employed guide) that opens an organisation in Vociamo and uses it for its own tours. Whoever creates the organisation declares they may bind it. Tour visitors are not party to this agreement: for them the short privacy notice shown on the tour page applies.
2. What the service includes
- Access to the web app
vociamo.appto create tours, stops and glossaries, add guides and moderators, open a tour to visitors with a QR code and run it live. - Real-time machine translation of what the guide says, as synthetic voice and captions, into every language of the catalogue (25 today), on one shared channel per language: every visitor who chooses the same language hears the same channel.
- Visitors' written questions, translated into the guide's language, and the "raised hand".
- The usage report (minutes spoken, characters translated and synthesised) on the "Usage" page.
- Support by email at the address above, on working days.
It does not include: devices (phones, earphones, signs), connectivity, human interpreters, tour recording (off by default), any guarantee of translation quality (see section 5).
3. Price and invoicing
Price, duration and payment terms are in the written commercial offer the customer accepts in writing (email is fine) before using the paid service. Without an accepted offer the service is a trial: free, limited in time and revocable by us at any time with 7 days' notice.
Usage is measured by the counters on the "Usage" page (minutes of recognised speech, characters translated, characters synthesised per language), which are binding for invoicing except in case of obvious error. Unless the offer says otherwise, invoices are monthly in arrears: at the start of each month, for the previous month's usage.
4. Customer obligations
- Inform participants that they are listening to a machine translation and that their written questions reach the guide (the privacy line on the tour page, which is part of the service, is enough).
- Do not record, or let anyone record, people's voices without their consent; the "record the stop" feature is for the guide to record their own voice.
- Do not use the service for unlawful or offensive content or content that infringes third-party rights, and answer for what your guides say and for what you upload into glossaries and stops.
- Keep account credentials safe and remove anyone who leaves the organisation from it immediately; every action taken with an account is deemed taken by its holder.
- Do not try to circumvent technical limits, probe the service's defences or disturb other customers.
5. Machine translation: what we promise and what we do not
Translation is done by programs, not people. It makes mistakes: on proper names, numbers, irony, dialects, long sentences without pauses, background noise. The glossary approved by the customer reduces errors on important names but does not remove them. Vociamo is therefore a support tool for the guide, not an interpreter: the customer must not rely on machine translation for communications on which people's safety, medical or legal decisions, or financial commitments depend, without human verification.
We undertake to provide the service diligently and with the providers listed in the privacy notice; we do not guarantee that the translation is correct, complete or fit for a particular purpose.
6. Availability
The service is provided "as is" and without any guarantee of continuity: today the engine and the audio switchboard run on a single server, and a failure during a tour interrupts translation until it is restored (usually minutes, in serious cases hours). If the customer needs an availability guarantee, it must be written into the commercial offer together with the price of the standby.
We may suspend the service for maintenance, giving 24 hours' notice when possible and never, except in an emergency, during a tour the customer has announced to us in advance.
7. Suspension and termination
We may suspend the account or the organisation, with notice by email, in case of unlawful use, of non-payment more than 15 days after a reminder, or of behaviour that puts the service at risk for others. The customer may ask at any time, by email, for the organisation to be closed; data follows the rules of the privacy notice (usage counters are kept for invoicing).
Either party may withdraw with 30 days' notice by email; sums due for usage already made remain due.
8. Liability
To the extent permitted by law, our liability towards the customer for any damage connected with the service is limited to what the customer paid us in the 12 months before the event, and does not cover loss of profit, indirect damage or damage to reputation. Nothing in these terms limits liability for wilful misconduct or gross negligence, or liability the law does not allow to be limited.
9. Personal data
For operator accounts we are the data controller (see the privacy notice). For tour content (what guides say, visitors' questions, glossaries) the controller is the customer and we process the data on its behalf as processor: the data processing agreement (annex A, ACCORDO-TRATTAMENTO-DATI.md, Italian with an English summary, Article 28 GDPR) is part of these terms. The providers we use and the places where data is kept are listed in the privacy notice; the customer authorises us to use them.
10. Ownership
The software, the Vociamo name and the mark are ours. The customer's content (stops, glossaries, stop recordings) remains the customer's; the customer allows us to process it only to provide the service. Transcripts of guides' speech and their translations exist only for the time stated in the privacy notice. The audience's download is off until the customer turns it on for an event; by turning it on, the customer undertakes to have told the speaker (for example the lecturer of a lesson or the speaker at a conference).
11. Changes to these terms
We may update these terms; changes apply to new contracts and, for ongoing ones, 30 days after notice by email, unless the customer withdraws within that period.
12. Law and jurisdiction
Italian law applies. Any dispute is subject to the courts of Pontassieve (Florence), without prejudice to the mandatory consumer forum when the customer is a natural person acting outside their trade or profession.
